1. About These Terms

These Terms of Use apply to our website and to Nativ, Engine and our other software and services (together, the “Services”). The Services are provided by Neywa Labs sp. z o.o., Aleja Pokoju 18D, 31-564 Kraków, Poland, KRS 0001261513 (“Neywa Labs”, “we”, “us”).

By using the Services, you agree to these terms. If you don’t agree, please don’t use them.

2. Who Can Use the Services

You must be at least 16 years old to use the Services. If you use them on behalf of a company or other organization, you confirm that you are allowed to accept these terms for it.

3. Open-Source Software

Nativ and Engine are open-source software released under the MIT License. The license that comes with the code governs how you may use, copy, change and share it, and nothing in these terms limits the rights it gives you.

4. AI Models and Your Content

The Services let you download and run AI models made by third parties. Each model comes with its own license and terms, and you are responsible for following them. We don’t make these models and can’t guarantee what they produce: outputs can be wrong, incomplete or inappropriate, so check them before relying on them.

Your prompts, files and model outputs stay on your device and remain yours. You are responsible for what you put into the models and how you use what comes out. How we handle information is explained in our Privacy Policy.

5. Acceptable Use

When using the Services, you agree not to:

• break the law or infringe anyone else’s rights;
• disrupt, overload or try to gain unauthorized access to our website or systems;
• use our name or logos, or suggest you are affiliated with us, without our written permission.

6. Our Name and Website

The Neywa Labs, Nativ and Engine names and logos, and the content of our website, belong to us. Open-source code is covered by its own license, as described in Section 3.

7. Paid Plans

The Services are currently free. If we offer paid plans, such as Nativ Pro, we will show you their terms, including price, billing and cancellation, before you buy.

8. No Warranty

We work hard to make the Services useful and reliable, but we provide them “as is” and “as available”. To the extent the law allows, we make no promises that they will be error-free, uninterrupted or suitable for a particular purpose.

9. Limitation of Liability

To the extent the law allows, we are not liable for indirect or consequential losses, lost profits, or lost data arising from your use of the Services.

Nothing in these terms limits our liability for harm we cause intentionally or through gross negligence, for personal injury, or for anything else that cannot be limited by law. If you are a consumer, these terms do not affect the rights that consumer protection law gives you.

10. Changes

We may change or stop offering any part of the Services. We may also update these terms; when we do, we will post the new version here and update the date at the top. If a change is significant, we will give reasonable notice. Using the Services after a change means you accept the updated terms.

You can stop using the Services at any time.

11. Governing Law and Disputes

These terms are governed by Polish law, and disputes will be handled by the courts in Kraków, Poland. If you are a consumer living in another country, you also keep the protection of the mandatory laws of that country and may bring a claim in its courts.
